In an interview with The Law Society Gazette, published on 12 August, Lord McNally, the minister at the Department of Justice, is reported as saying:
- “Mediation is usually quicker and cheaper than costly and stressful court battles, and regularly produces better outcomes that people are willing to stick with. We are determined to make sure more and more people make use of the excellent services available.”
The same article cites a success rate of over 80% in disputes which go to mediation, a percentage that is similar to that reported by most mediators, and which is supported by our own experience.
For as long as there are still sceptics out there, and there are, you may wish to use this as another means of persuasion in order to bring the other side, and more importantly their lawyers, into mediation.
Interestingly, CEDR is quoted as saying that an experienced mediator would “typically” charge between £4,000 and £6,000 for the preparation and the day’s work in a mediation, so our current rates must be considered good value!
